JiWell — Terms Of Use

1. Introduction

Welcome to JiWell AB ("JiWell", "we", "us"). These Terms of Use (the "Terms") govern your access to and use of JiWell's website(s) and mobile application(s) (the "Service").

By creating an account, clicking "I agree", or by using the Service, you confirm that you have read, understood and consent to these Terms as well as our Privacy Policy.

Certain features may be provided by third-party technology (e.g. payments via Stripe and AI services). The use of these is also subject to the terms of the respective third party.

2. Important health information

If you have known illnesses or medical conditions, you must immediately stop using the Service and consult licensed healthcare professionals before continuing to use it.

3. Disclaimer – Wellness support and tracking tools

JiWell provides wellness and lifestyle support as well as logging tools. JiWell is not a medical device, does not provide diagnosis, treatment or cure, and does not replace professional care or advice.

4. Critical health disclaimer

Use of the Service is at your own risk. If you have pre-existing medical conditions, you must consult a healthcare provider before using the Service. If a healthcare provider advises against it, you must cease use immediately.

5. Disclaimer – not medical advice

Content in the Service (e.g. articles, calculations, projections) is general information only and not medical advice. Results may vary. Do not make any health or dietary changes without the supervision of a licensed healthcare provider.

6. Additional disclaimer for minors

Minors under 18 may only use the Service with the consent and active supervision of a parent or legal guardian. Children under 13 may not use the Service. JiWell is not responsible for use without the necessary supervision.

7. Ownership and intellectual property rights

All content in the Service belongs to JiWell or its licensors. No license is granted beyond what is expressly stated in these Terms. Unauthorized copying, distribution, reverse engineering and similar activities are prohibited.

8. Consent regarding user-generated content

By submitting, uploading or posting content ("UGC"), you grant JiWell an irrevocable, non-exclusive, worldwide, transferable and sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, perform and display the UGC for the purpose of operating and improving the Service. You are solely responsible for your UGC and warrant that you hold the necessary rights. Do not post unlawful, abusive, offensive or privacy-sensitive material.

9. Service changes and interruptions

We may at any time change, update, suspend or discontinue the Service, including through automatic updates. We are not liable for changes or interruptions, to the extent permitted by law.

10. Account monitoring and compliance

We may monitor activity in order to maintain security and compliance. In the event of violations, we may issue warnings, impose restrictions, remove content, suspend or terminate accounts – sometimes without prior notice if the situation so requires.

11. Community standards and disclaimers of endorsement and liability

11.1 Community standards

No threatening, harassing, hateful, discriminatory or violence-promoting material. Promoting unhealthy weight-loss methods or eating disorders is prohibited. No disruptions, attacks, automated attacks or resource abuse.

11.2 Endorsement

Opinions expressed by users or external contributors are their own and do not necessarily represent JiWell's positions.

11.3 Disclaimer of liability

JiWell is not responsible for the accuracy or reliability of UGC. Interaction takes place at your own risk.

12. User-generated content

You retain ownership of your UGC but grant JiWell and other users the licenses necessary for the Service to function. We may moderate, move or remove UGC that violates the Terms or the law.

13. Permitted users

13.1 Persons with serious medical conditions

Use the Service only after express clearance from a healthcare provider.

13.2 Persons with a history of eating disorders

Use is discouraged without medical follow-up.

13.3 Children and minors

Under 13 years of age is prohibited. Ages 13–17 only with the consent and supervision of a parent or legal guardian.

13.4 Parental responsibility

Parents and legal guardians are responsible for minors' use and are bound by the indemnification undertaking (section 20).

14. Fees and pricing

JiWell is currently free to use. We reserve the right to introduce fees in the future (e.g. a monthly fee of SEK 29) or paid optional features. If pricing is introduced, we will announce this in the Service and update these Terms before any fees take effect. Any purchases in the shop are handled via Stripe and are subject to their terms and privacy policy.

15. Registration and password security

You are responsible for keeping your login credentials confidential, using a strong password, and notifying us immediately in the event of a suspected breach.

16. Security warnings and incident notifications

We work to maintain good security but cannot guarantee absolute protection. Notify us promptly if you suspect unauthorized access. Measures may vary depending on the nature of the incident.

17. Third-party links and liability

The Service may contain links to external websites. We are not responsible for their content or policies. We use, among others, Stripe for payments and may use AI services (e.g. OpenAI); such use is subject to the terms of the respective provider. You may only link in accordance with good practice and without giving the impression of sponsorship or partnership. Framing, use of trademarks or other special use requires our written approval.

18. Disclaimer of warranties

The Service is provided "as is" and "as available". We make no warranties (express or implied) to the extent permitted by law.

19. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, lost profits, loss of data or other consequential damages. Our total liability is limited to the fees you have paid for the Service during the last twelve (12) months preceding the claim, unless mandatory law provides otherwise (currently SEK 0, as the Service is free).

20. Indemnification

You undertake to hold JiWell and its representatives harmless from claims arising out of your use of the Service, your UGC, or your violation of the Terms or the law.

21. Governing law and venue

Swedish law shall apply (excluding its conflict-of-law rules). Disputes shall be settled by the Swedish general courts, with Stockholm District Court as the court of first instance. Consumers are always entitled to the protection afforded by mandatory consumer law in their home country within the EEA.

22. Dispute resolution

The parties shall first seek to resolve disputes informally. Consumers may turn to the Swedish National Board for Consumer Disputes (ARN) or the EU's ODR platform. To the extent permitted by law, the parties waive the right to bring class actions; this does not affect mandatory law within the EEA.

23. Intellectual property rights and infringement

All material in the Service is protected by copyright, trademark law and similar rights. In the event of alleged infringement, send a notice with a description of the work, its location (URL/screen), contact details and a good-faith statement to info@jiwell.se. We may remove material and terminate the accounts of repeat infringers. We grant a limited, revocable, personal, non-transferable and non-exclusive license to use the Service for private use. Commercial use requires our written permission.

24. Changes to the Terms

We may update the Terms. Significant changes will be announced in the Service. Continued use after the effective date constitutes acceptance. If payment is introduced, clear advance information and updated terms will be provided.

25. Mobile services

The Service requires a compatible device and a network connection. Carrier charges may apply. We do not guarantee compatibility with all devices or versions.

26. International terms and consumer rights

We comply with mandatory consumer law where you reside within the EEA. The Swedish Distance Contracts Act may give consumers a right of withdrawal for certain purchases. For digital content or services that have commenced during the withdrawal period, the right of withdrawal may lapse following your express consent. Physical goods in the shop are subject to the applicable right of withdrawal and right to file complaints. Payments are handled by Stripe under their terms and privacy policy.

27. Provisions that survive termination

The following provisions apply also after termination: 7, 8, 12, 18–23, 27–29.

28. Miscellaneous

These Terms constitute the entire agreement between you and JiWell regarding the Service. Failure to enforce a right does not constitute a waiver. An invalid provision shall be replaced by a valid one that closely reflects the original intent. You may not assign the agreement without our written consent. Notices may be sent via the app, by email or by post.

29. AI features and third-party integrations (e.g. OpenAI)

The Service may use AI features for recommendations and responses. AI output is informational, not medical advice, and may be incorrect or incomplete. Use may be subject to third-party policies (e.g. OpenAI). Personal data is processed in accordance with JiWell's Privacy Policy. AI features may be changed or discontinued without prior notice. JiWell is not affiliated with OpenAI or other AI providers unless expressly stated.
